Terms.
The short version: you pay, you get the photos and can use them for what you booked me for, and I keep the copyright. The rest is below. These apply to any job you book with me, and booking means accepting a quote.
Who's who
"I" and "me" is Gwonho, a sole trader based in Brisbane. "You" is whoever accepts the quote. "The photos" means everything I shoot on the job, photos and video, whether you end up getting it or not. If we've both signed a separate agreement for a job, that wins where it says something different to this page.
Quotes and booking
A quote's good for 30 days and covers what it says. If the job changes, the price might too, and I'll tell you the new price before I do any extra work. A booking's locked in once we've agreed on the price and the date in writing, and an email or a message through the contact form counts.
I might update these terms now and then. Whatever version was up when you accepted your quote is the one that applies to your job.
Paying
Payment terms are on the invoice. You get the final files once it's paid in full, unless we've agreed something different in writing.
Weather and cancelling
Drones and bad weather don't mix. If it's not safe or legal to fly, I'll move the shoot and let you know as early as I can. That's my call. If you need to move it, just tell me as soon as you know. If you cancel or move it too late for me to book that time with someone else, I may charge for the time I'd set aside, and I'll tell you before I invoice for it.
Who owns the photos
I do. Copyright in everything I shoot stays with me, and booking me gets you a licence to use the photos, not the copyright itself.
That includes private jobs like portraits and family shoots. Under the Copyright Act 1968 (Cth), copyright in a photo commissioned for a private or domestic purpose would normally go to the person who paid for it. By accepting a quote you agree that it doesn't, and that I keep it instead. Section 35(3) of the Act allows for that, and this is that agreement.
What you can do with them
Once you've paid, you can use the photos for your own business wherever and for as long as you like, with nothing more to pay. Your website, socials, listings, print, ads, signage, tenders, all fine. For a private job, you can use them however you personally want, including printing them and sharing them with family and friends. Crop and resize them to fit wherever they're going. Tagging me is appreciated but you don't have to.
What you can't do with them
You can't, and can't let anyone else:
- sell them, or pass on or sell the right to use them
- give them to another business to use as its own. If a property moves to a new agency, that agency needs its own licence from me
- upload them to a stock photo site
- enter them in a competition or award as your own work
- use them to train AI, or let anyone else do that
- edit them in a way that misrepresents what's in them, or put someone else's name on them
If any of that happens, your licence to use the photos ends straight away. Nothing here waives my moral rights under the Copyright Act.
Me using them
I might post photos from the job on this site or on social media to show my work. If you'd rather keep the job private, tell me before the shoot and I won't. If something's already up and you want it down, just ask.
Raw files
You get the edited photos, not the raw files. If you need a different crop or format of one I've delivered, ask and I'll sort it.
Drones
I'm CASA accredited, the drone's registered, and I fly by CASA's rules. Those rules limit where, how high and how close to people I can fly. If your job needs an approval or is in restricted airspace, I'll tell you when I quote. Safety comes first, so if a shot can't be done safely or legally, I won't take it, and that isn't breaking our agreement.
Your part
Make sure I can get onto the site at the agreed time, and tell me about any hazards or site rules. If people are going to be in the photos, let them know it's happening. Anyone under 18 needs a parent or guardian's OK.
If something goes wrong
Tell me as soon as you can and I'll try to fix it. As far as the law allows, the most I'm liable for on a job is what you paid for it, and I'm not liable for indirect losses like lost profit, lost sales or a delayed campaign. None of this takes away your rights under the Australian Consumer Law.
The legal bits
Queensland law applies, and Queensland courts can hear any dispute. I don't publish an address, email or phone number, so if you need to reach me about any of this, use the contact form.
